Nanny State Chronicles

UPDATE: If this post popped up in your reader or aggregator again, it's because I am sadly having to update it regarding more evil attempts to destroy American liberty. Scroll to the end for the latest update.

Can't you people see where this stuff is going? It bears repeating the immortal poem by Martin Niemöller (1892–1984) about the inactivity of German intellectuals following the Nazi rise to power and the purging of their chosen targets, group after group.
They came first for the Communists,
and I didn't speak up because I wasn't a Communist.

Then they came for the Jews,
and I didn't speak up because I wasn't a Jew.

Then they came for the trade unionists,
and I didn't speak up because I wasn't a trade unionist.

Then they came for the Catholics,

Speak up against this crap in public, and bother the hell out of your stuck-up elected officials, who really couldn't care less about what you think (to tell you the truth) when these fascist measures come up in legislatures for a vote. They're "too busy" to ask you how they should vote in order to truly represent you. They're too busy slopping at lobbyists' troughs, puffing up their own self-importance, and calculating the safest course toward re-election, is how they're too busy. Get in their fucking faces and scare the shit out of 'em. That's what it means to be an American. What are YOU?

Organs to be taken without consent: This is from the UK, but England is a harbinger of what we can expect over here. This is just an extension of nanny stater Al Gore's law making it a crime to sell your bodily organs. You thought maybe you owned your own body? Ooops, think again; the state does. China is harvesting organs from executed people and selling them to rich Western sickos. What we'll see next is a law making failure to say "NO organ donation" -- on your driver license or in some other more obscure location -- tantamount to consent for your body to be chopped up for some vampire sicko's life extension project and some doctor's bank account.

Cash carrot for obese people to lose pounds: "Obese and overweight adults in England could be paid to lose weight under plans being considered by the Government." Another great idea from some government official dipshit in the UK. So soon, not only do we have to pay more taxes to give obese fucks food stamp cards to buy sugary fattening food and drinks in front of us in the grocery checkout line, we'll also have to bribe the fat fucks not to eat their free food.

California wants to control home thermostats: Here's one closer to home.

Next year in California, state regulators are likely to have the emergency power to control individual thermostats, sending temperatures up or down through a radio-controlled device that will be required in new or substantially modified houses and buildings to manage electricity shortages.

The proposed rules are contained in a document circulated by the California Energy Commission, which for more than three decades has set state energy efficiency standards for home appliances, like water heaters, air conditioners and refrigerators.

The changes would allow utilities to adjust customers' preset temperatures when the price of electricity is soaring. Customers could override the utilities' suggested temperatures. But in emergencies, the utilities could override customers' wishes.

Final approval is expected next month.

I'm not making this shit up. Illegal aliens, parents greedy for offspring, and welfare brood hens are using so much energy that the people who can pay have to go back to the Middle Ages and freeze their asses off with them. What a country we've become.

Father Sent To Jail For Spanking 16 Year-Old Daughter: Even closer to home, in dear old, increasingly nanny state Tennessee.

A McMinnville father has been ordered to jail for spanking his 16 year-old daughter. John T. Cox was found guilty Friday, February 2, 2008, on a domestic assault charge.

His daughter said Cox had spanked her following an argument she had with her father's girlfriend.

Cox was ordered to serve two days of an 11-month, 29-day sentence and attend anger management classes. He was also ordered not to spank or physically punish his daughter when he has visitation.

I don't know the particulars of this; but I do know that parents have become fearful of physically disciplining their children because the kids have gotten wise that they can call the authorities and get some social worker genius to prosecute Mom or Dad. Teenage daughters are especially wise to this. Are you aware that the domestic violence conviction means that the father can no longer possess a firearm, even to go hunting or protect his own life from a burglar in the house?

This country is getting so fucked up. But hey, don't miss the next episode of American Idol, fool!

Wait! Here's a good one: Mississippi Pols Seek To Ban Fats: New bill would make it illegal for restaurants to serve the obese. Here's some TV coverage. There could also be a weigh station at the grocery checkout. The person trying to buy groceries would have to stand on the scale while a laser measured her/his height and calculated the Body Mass Index. Score over a certain level, and you would not be allowed to buy certain fattening foods. It's whole wheat bran or take a walk, baby!

I told you, what goes around comes around. And if you weren't there for me, I won't be there when they come for you. What's that you say? Duuuhhhhh.

UPDATE: Lakeland ordinance aims to stop unnecessary cutting. And you thought you owned and could control the trees on your own property. Not if you live amidst the nanny-staters in Lakeland, Tennessee.

UPDATE: Tennessee University Bans Smoking: " East Tennessee State University announced it will ban tobacco from its campus starting in the fall. ETSU President Paul Stanton announced the policy change in a news release, saying tobacco will only be permitted in private vehicles."

UPDATE: Two Arrested for Getting High With Laughing Gas: "Police in Arkansas arrested two people inside a West Memphis motel room for getting high with laughing gas."

UPDATE: '£10 licence to smoke' proposed: "Smokers could be forced to pay £10 for a permit to buy tobacco if a government health advisory body gets its way. No one would be able to buy cigarettes without the permit, under the idea proposed by Health England."

UPDATE: Law would end small-engine motorcycle licenses for young teens. OK people, has your ox been gored yet? "About 85 teens currently have the limited licenses." Woo-hoo, 85 whole kids whose parents want them to have these licenses? Hey, to Nanny-Staters, a probability of saving one life against any risk, however small, is enough to take more liberty away. This Republican Senator Tim Burchett is shaping up to be a real enemy of freedom. I may have to start profiling these dangerous fools individually.

Ace Reporter Bill Dries at The Daily News

I was recently reminded by LeftWingCracker's naming Memphis' best newspapermen that I have been meaning to do a post recognizing the great Bill Dries in the context of mentioning what his hiring means for the future of The Daily News of Memphis, Tennessee.

I've been seeing Bill Dries in the political and legal trenches ever since I can remember hanging around the corridors of power. I've never heard anyone complain about him burning a source or being unfair. And man is he thorough! I'm going to link you to a story of his that proves that in spades.

But first, do you fully appreciate how strong The Daily News is coming on as a great source for local coverage? I have it on my newsreader (here's their RSS feed) and so get many stories daily of local interest, in considerable depth.

It seems the managers there have foreseen the quite possible consequence of consumers receiving news over the Internet: that The Daily News doesn't need a large, widely delivered print edition to kick the Commercial Appeal's butt in the local news department. And frankly, local news is all that a local or regional daily can deliver that readers can't get better nowadays from the national media's websites, especially through a time-saving newsreader program on their PC's.

That's why it's so significant that The Daily News has brought someone of Bill Dries' quality on board and let him do what he's done so well for so long as a savvy Memphian. Plus, while there are a few other good reporters working in Memphis, at the TV stations as well as the print media, how many are as personable, unassuming, approachable, appreciative, and consummately professional as Bill Dries?

It might have been one of the more unique statements ever made during a sentencing hearing in Memphis federal court.

"I didn't realize the girl shows were prostitution. But I should have," strip club owner Ralph Lunati told U.S. District Court Judge Hardy Mays last week in the U.S. District Court for the Western District of Tennessee.

Someone send this to Larry Buser at the CA, please. Sometimes I think they impose a word limit on his courthouse coverage; and I've never seen him using a camera at 201. Larry, you're good; and I consider us to be healthy nodding acquaintances. Don't get mad just 'cause I'm giving Bill some well-deserved digital ink.

Tennessee's Media Shield Law

In law school you learn the truism: "Look at the statutes first." Well, I forgot I had saved these links, and I'm going to include the full text inline for your convenience.

39-16-404. Misuse of official information. —

(a) A public servant commits an offense who, by reason of information to which the public servant has access in the public servant's official capacity and that has not been made public, attains or aids another to attain a benefit.

(b) An offense under this section is a Class B misdemeanor.

Your general B misdemeanor carries up to six months in prison and up to a $500 fine,

24-1-208. Persons gathering information for publication or broadcast — Disclosure. —

(a) A person engaged in gathering information for publication or broadcast connected with or employed by the news media or press, or who is independently engaged in gathering information for publication or broadcast, shall not be required by a court, a grand jury, the general assembly, or any administrative body, to disclose before the general assembly or any Tennessee court, grand jury, agency, department, or commission any information or the source of any information procured for publication or broadcast.

(b) Subsection (a) shall not apply with respect to the source of any allegedly defamatory information in any case where the defendant in a civil action for defamation asserts a defense based on the source of such information.

(c) (1) Any person seeking information or the source thereof protected under this section may apply for an order divesting such protection. Such application shall be made to the judge of the court having jurisdiction over the hearing, action or other proceeding in which the information sought is pending.

    (2) The application shall be granted only if the court after hearing the parties determines that the person seeking the information has shown by clear and convincing evidence that:

        (A) There is probable cause to believe that the person from whom the information is sought has information which is clearly relevant to a specific probable violation of law;

        (B) The person has demonstrated that the information sought cannot reasonably be obtained by alternative means; and

        (C) The person has demonstrated a compelling and overriding public interest of the people of the state of Tennessee in the information.

    (3) (A) Any order of the trial court may be appealed to the court of appeals in the same manner as other civil cases. The court of appeals shall make an independent determination of the applicability of the standards in this subsection to the facts in the record and shall not accord a presumption of correctness to the trial court's findings.

        (B) The execution of or any proceeding to enforce a judgment divesting the protection of this section shall be stayed pending appeal upon the timely filing of a notice of appeal in accordance with Rule 3 of the Tennessee Rules of Appellate Procedure, and the appeal shall be expedited upon the docket of the court of appeals upon the application of either party.

        (C) Any order of the court of appeals may be appealed to the supreme court of Tennessee as provided by law.

Irresponsible Reproduction on the Rise Again

I just post this stuff to get it out of my craw and off my saved Favorites. I don't expect that people will let such news affect their public affairs passivity. First, from Reuters, "Teen births tilt up, unmarried rate hits record":
The birth rate for teenagers increased in 2006 in the United States for the first time since 1991, while childbearing among unmarried women surged to the highest level on record, health officials said on Wednesday.
. . . .
The birth rate for females aged 15 to 19 rose by 3 percent in 2006 from the previous year, to 41.9 live births per 1,000 from 40.5 in 2005. This ends 14 years of declines during which the teen birth rate dropped by 34 percent from a peak of 61.8 births per 1,000 in 1991.

The increases were largest among black teens, whose birth rate climbed 5 percent in 2006 from the prior year. The rate was up 3 percent for white and 2 percent for Hispanic teens.

Now, these are not births to barely nubile females who have been married off to men acceptable to the families involved.

Births to unmarried girls and women reached their highest levels in 2006 since the government began tracking such statistics in 1940, Ventura said.

Unmarried girls and women accounted for 38.5 percent of all U.S. births last year, up from 36.9 percent in 2005. Among blacks, they accounted for 70.7 percent of births. Among Hispanics, it was 49.9 percent and among whites 26.6 percent.

The out-of-wedlock birth rate rose by a sharp 7 percent last year. Ventura said from about 1995 to 2002, statistics on births by unmarried women had remained pretty stable, but since then have been on the way up. About 40 percent of unmarried women giving birth are in cohabiting relationships, she added.

The females doing this, hey, you're not some rich Hollywood actress who can pay all the expenses for the baby, a nanny, etc., even if that would make it all right. You're going to end up hitting the welfare system and the natural father for child support sooner or later, and burden your own mother with helping out with the baby so you can be freer to work or party. You and the child are going to pay dearly for your arrogance, that you can raise a child "on your own." Sheesh, 60% of the dummies dropping babies outside marriage don't even have the father living with them. This shit needs to stop, but it won't. It will just get worse. Female "empowerment," eh?

Overpopulation News

Once in a while I encounter an article that warms the cockles of my heart. From The Advertiser via news.com.au (Australia), "Baby tax needed to save planet, claims expert":
A WEST Australian medical expert wants families to pay a $5000-plus "baby levy" at birth and an annual carbon tax of up to $800 a child.

Writing in today's Medical Journal of Australia, Associate Professor Barry Walters said every couple with more than two children should be taxed to pay for enough trees to offset the carbon emissions generated over each child's lifetime.

Professor Walters, clinical associate professor of obstetric medicine at the University of Western Australia and the King Edward Memorial Hospital in Perth, called for condoms and "greenhouse-friendly" services such as sterilisation procedures to earn carbon credits.

And he implied the Federal Government should ditch the $4133 baby bonus and consider population controls like those in China and India.

"Far from showering financial booty on new mothers and rewarding greenhouse-unfriendly behaviour, a 'baby levy' in the form of a carbon tax should apply, in line with the 'polluter pays' principle."

Couples who have more than two children are being “irresponsible” by creating an unbearable burden on the environment, the government’s green adviser has warned.

Jonathon Porritt, who chairs the government’s Sustainable Development Commission, says curbing population growth through contraception and abortion must be at the heart of policies to fight global warming. He says political leaders and green campaigners should stop dodging the issue of environmental harm caused by an expanding population.
